Bench Trial - Oct 22-24, 1991

Part One
Part Two

Judgement

Verdict Oct 29, 1991

This was Judge Mackey's first class-A felony trial, he'd only been on the bench for less than a year. He should have recused himself gracefully at the beginning and saved himself the embarrassment to come later. Whether or not the matter that ensued was handle properly or not - he was by far NOT impartial and was clearly blinded by his past, the media or his admiration of the little girl. The statements he makes in this decision prove his own confirmation bias. A wise man should have been aware of the charade that played out before him - and whether he liked the defendant or not - should have noted that he was not getting a fair trial Yet he played into the unbelievable tragedy from the beginning by having a clearly confused boy with IDD assess himself as being competent to waving his right to a jury trial.

PCR Brief

*********************************

Shortly after the trial it is discovered that Judge Mackey was the victim of sexual assault and Attorney Dean Stowers from the Rosenberg Law Firm is hired. For the next 10 years Stowers relentlessly pursues the goal of setting an Iowa precedence in this matter even against the warnings of Mr. Rosenberg and several judges. He ultimately sacrifices he own client's life for the sake of his own glory and loses everything, even a granted Habeas because of his tantrums and demands on the court.
